TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the use of the Heatness SA website and the purchase of products from Silverboom (Pty) Ltd trading as Heatness SA ("Heatness SA", "we", "our", "us").

By accessing this website or placing an order, you agree to be bound by these Terms and Conditions.

2. Products

Heatness SA supplies infrared heating panels, thermostats, accessories and related products.

Product photographs, colours and dimensions are provided as accurately as possible. Minor variations may occur and shall not constitute a defect.

Technical specifications may change without prior notice where product improvements are made.


3. Pricing

All prices displayed are in South African Rand (ZAR).

Prices include VAT where applicable.

Heatness SA reserves the right to change prices at any time before an order is confirmed.


4. Orders

An order placed through our website constitutes an offer to purchase.

Acceptance only occurs once payment has been successfully received and an order confirmation has been issued.

Heatness SA reserves the right to refuse or cancel any order due to:

  • pricing errors;

  • stock shortages;

  • suspected fraud;

  • payment failure;

  • incorrect product information.


5. Payment

Payments are securely processed through PayFast and other approved payment providers.

Heatness SA does not store customers' payment card information.

Orders will only be dispatched after payment has been successfully cleared.


6. Shipping and Delivery

Delivery is available throughout South Africa.

Estimated delivery times are provided for guidance only and are not guaranteed.

Risk passes to the customer upon delivery.

Ownership remains with Heatness SA until payment has been received in full.


7. Installation

Electrical installation must comply with South African electrical regulations.

Where applicable, installation should be carried out by a qualified electrician.

Heatness SA shall not be liable for damage arising from incorrect installation or misuse.


8. Warranty

Unless otherwise stated, Heatness infrared heating panels include a four (4) year limited manufacturer's warranty.

The warranty covers manufacturing defects only.

The warranty does not cover:

  • incorrect installation;

  • misuse;

  • accidental damage;

  • water damage;

  • electrical surges;

  • normal wear and tear;

  • modifications or unauthorised repairs.


9. Consumer Protection

Nothing contained in these Terms limits any rights afforded to consumers under the Consumer Protection Act, 68 of 2008.

Customers retain all statutory rights available under South African law.


10. Limitation of Liability

Heatness SA shall not be liable for any indirect, incidental, consequential or special damages arising from the use of its products.

Our total liability shall never exceed the purchase price paid for the relevant product.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.


11. Intellectual Property

All website content including photographs, logos, product descriptions, graphics and text remain the property of Heatness SA.

No material may be copied or reproduced without prior written consent.


12. Website Availability

Although every effort is made to maintain continuous access, Heatness SA cannot guarantee uninterrupted availability of the website.

We reserve the right to suspend or modify the website without prior notice.


13. Privacy

Personal information is processed in accordance with applicable South African privacy legislation, including POPIA.


14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the South African courts.

16. Electrical Installation

Certain Heatness SA products require installation in accordance with applicable South African electrical regulations.

Where installation involves permanent electrical connections, it must be carried out by a suitably qualified and registered electrician.

Heatness SA shall not be responsible for any injury, damage, malfunction or loss resulting from:

  • incorrect installation;

  • installation that does not comply with applicable electrical standards;

  • modifications to the product;

  • installation by unqualified persons.

Failure to comply with these requirements may void the product warranty.


17. Product Use

Heatness SA products are intended solely for their designed purpose as indoor infrared heating appliances unless expressly stated otherwise.

Customers are responsible for ensuring that products are suitable for their intended application before purchase.


18. Force Majeure

Heatness SA shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to:

  • power failures;

  • load shedding;

  • natural disasters;

  • floods;

  • fire;

  • strikes;

  • transport disruptions;

  • acts of government;

  • pandemics;

  • supplier shortages;

  • import delays.

Delivery dates shall automatically be extended for the duration of such events.


19. Limitation of Warranty

Except for statutory rights provided under the Consumer Protection Act, no additional warranties, whether express or implied, are given.

Heatness SA specifically excludes any implied warranties of fitness for a particular purpose unless expressly agreed in writing.


20. Order Cancellation

Orders may only be cancelled before dispatch.

If an order has already been shipped, the Returns and Refund Policy shall apply.

Heatness SA reserves the right to deduct any direct costs already incurred where permitted by applicable law.


21. Inspection Upon Delivery

Customers should inspect all goods immediately upon delivery.

Any transit damage or shortages should be reported within 48 hours.

Failure to notify Heatness SA within a reasonable period may affect claims relating to transport damage.


22. Electronic Communications

By using this website or placing an order, customers consent to receiving communications electronically, including invoices, order confirmations and warranty information.

Electronic records shall satisfy any legal requirement for written communication where permitted by law.


23. Severability

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

Heatness SA reserves the right to amend these Terms and Conditions at any time.

The version published on the website at the time of purchase shall apply to the relevant transaction.

REFUND AND RETURNS POLICY

Effective Date: 06 August 2026

At Heatness SA we aim to provide high-quality products and excellent customer service.

This Refund and Returns Policy complies with the South African Consumer Protection Act (CPA).

1. Returning Products

Customers may return products under the following circumstances:

  • the product is defective;

  • the incorrect product was supplied;

  • the product was damaged during delivery;

  • the product is materially different from what was ordered.

Please notify us within 7 days of delivery if any of the above applies.


2. Cooling-Off Period

Where applicable under South African consumer law, customers may exercise their statutory cooling-off rights.

Returned products must:

  • be unused;

  • be in original packaging;

  • include all accessories and documentation.

Customers are responsible for return shipping costs unless the return results from an error by Heatness SA or a defective product.


3. Defective Products

Products found to have manufacturing defects may, at our discretion and in accordance with the Consumer Protection Act, be:

  • repaired;

  • replaced; or

  • refunded.

Heatness SA may inspect products before approving any claim.


4. Non-Returnable Items

The following products cannot be returned unless defective:

  • products damaged through misuse;

  • products incorrectly installed;

  • products modified or repaired by unauthorised persons;

  • products damaged by power surges, water or negligence.


5. Refunds

Approved refunds will be processed to the original payment method used during purchase.

Refunds are generally processed within 5–10 business days after approval.

Bank processing times may vary.


6. Exchanges

Where stock is available, customers may request an exchange instead of a refund.


7. Warranty Claims

Warranty claims are handled separately under the Heatness SA Warranty Policy.

Proof of purchase is required for all warranty claims.

9. Products Damaged During Transit

If a shipment arrives visibly damaged, customers should:

  • photograph the packaging before opening;

  • photograph the product;

  • notify Heatness SA within 48 hours of delivery.

This assists in processing claims with the courier.


10. Return Shipping

Where a return is approved due to a defective or incorrectly supplied product, Heatness SA will arrange collection or reimburse reasonable return shipping costs.

Where a customer returns a product for reasons other than a defect or legal entitlement, return shipping costs remain the customer's responsibility.


11. Inspection of Returned Goods

Returned products will be inspected upon receipt.

Where inspection shows that damage resulted from misuse, improper installation, accidental damage or unauthorised modification, the product may not qualify for a refund or replacement.


12. Method of Refund

Refunds will only be issued using the original payment method used for the purchase.

Heatness SA cannot issue cash refunds for card or electronic payments unless required by law.


13. Business Customers

Where products are purchased for commercial or business use, certain rights available to consumers under the Consumer Protection Act may not apply to the same extent permitted by applicable law.
